Welcome to Sparkles Coworking. These Terms of Service ("Terms") govern your use of our coworking space, services, and website located at 2840 Bryan Ave, Fort Worth, TX 76104 ("Facility"). By accessing our Facility, using our services, or entering into a membership agreement with us, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services or enter our Facility.

Definitions

"Company," "we," "us," or "our" refers to Sparkles Coworking
"Member" or "you" refers to any individual or entity using our services
"Services" includes all coworking spaces, facilities, amenities, and related services
"Facility" refers to our coworking space and all associated areas
"Agreement" refers to any membership or service agreement between you and us

Membership and Access

Membership Types

We offer various membership plans including day passes, part-time, and full-time memberships. Each membership type has specific terms, access hours, and included services as detailed in your membership agreement.

Access Rights

Access is limited to your membership type and paid period
You must present valid identification and access credentials when requested
Access may be temporarily suspended for maintenance, emergencies, or security reasons
You may not grant access to non-members without prior authorization

Guest Policy

Guests may be permitted subject to our guest policies and advance notice requirements. All guests must be accompanied by the sponsoring member and are subject to these Terms.

Facility Rules and Conduct

General Conduct

All members and guests must:

Conduct themselves professionally and respectfully
Maintain a clean and organized workspace
Respect quiet zones and phone booth areas
Follow posted capacity limits and reservation systems
Properly dispose of trash and recyclables
Report any maintenance issues or security concerns promptly

Prohibited Activities

The following activities are strictly prohibited:

Illegal activities or activities that violate local, state, or federal laws
Harassment, discrimination, or disruptive behavior
Smoking, vaping, or use of illegal substances
Excessive noise or activities that disturb others
Unauthorized use of another member's workspace or belongings
Bringing weapons or dangerous items onto the premises
Commercial photography or filming without permission
Solicitation or unauthorized marketing activities

Security and Safety

You are responsible for securing your personal belongings
We are not liable for lost, stolen, or damaged personal items
Emergency procedures must be followed when announced
Security cameras may be in use throughout the Facility

Payment Terms

Fees and Billing

Membership fees are due in advance according to your billing cycle
Additional services may incur separate charges
Late payments may result in access suspension and late fees
All fees are non-refundable unless otherwise specified
We reserve the right to adjust pricing with 30 days' notice

Payment Methods

We accept various payment methods including credit cards, ACH transfers, and other approved methods. You authorize us to charge your selected payment method for all applicable fees.

Cancellation and Termination

Member Cancellation

You may cancel your membership with 30 days' written notice
Cancellation must be submitted through approved channels
No refunds for partial months unless required by law
All outstanding balances must be paid before cancellation is complete

Termination by Company

We may terminate your membership immediately for:

Violation of these Terms or Facility rules
Non-payment of fees
Conduct that endangers safety or disrupts operations
Fraudulent or illegal activities

Intellectual Property

All content, trademarks, logos, and intellectual property related to Sparkles Coworking remain our exclusive property. You may not use our intellectual property without written permission.

You retain ownership of your work and intellectual property created while using our services, but grant us permission to use your company name and logo for marketing purposes unless you opt out.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARKLES COWORKING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or business opportunities
Personal injury or property damage
Service interruptions or technical failures
Theft or damage to personal property
Actions of other members or third parties

Our total liability shall not exceed the amount paid by you for services in the three months preceding the incident.

Indemnification

You agree to indemnify, defend, and hold harmless Sparkles Coworking, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of third-party rights.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, labor disputes, or technical failures.

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Dispute Resolution Process

Any disputes arising from these Terms or your use of our services shall be resolved through:

Good faith negotiation between the parties

Binding arbitration if mediation fails

Jurisdiction

Any legal proceedings shall be conducted in the courts of Tarrant County, Texas.

Modifications to Terms

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
